Oh, boy. This is the big one for the EU. Interesting, so next week we find out if the EU has more freedom than the US. Bad ruling for poker in the EU, according to the court the possibility of fraud and other crimes in online gambling are good enough reasons for state monopolies. Portugal didn't even claim to fight gambling addiction for public health , which would have been a much more valid reason IMO.

Horrible, horrible. I think we'll see one of four camps in all the EU countries, and many other countries across the globe, very shortly: 1. One state-run monopoloy site. Licensing regime by the governement, with strict regulation and limitations, as in Italy. Open licensing and regulation program, a la Barney Frank bill. If we can get licensing and regulation legislation passed in the US, we will have one of the best online poker situations in the world. IMO, this decision may cause some poker sites to ignore these restrictive laws.

Individual nation markets will be too small for online poker sites. Therefore, they will ignore them because they are very difficult to enforce. The result will be that executives of online poker, and gambling, sites will have to live in jurisdictions like Malta, Isle of Man, Antigua and other small countries and avoid travel to Europe and the US.

Also, publicly traded online gambling sites may be forced to buy their shares and go private. Likely this process will take a few years and US legislation which I doubt will happen may change things.

However, in a few years, when online poker sites realize that these restrictive laws cannot be enforced, they will reenter markets, including the US, despite restrictive laws.
